General terms of use of the RubiconShop Web Shop 

These General Terms and Conditions of Use of the RubiconShop Web Shop determine the conditions under which the right to purchase and pay for products and services from the offer of Rubicon Sport d.o.o. via the Web shop. The web shop enables adult individuals and legal entities to choose and order products from the RubiconShop offer.

User Sing-Up

By logging in to use the Web shop, the user realizes the right to order the Product through the Web shop. When registering, the User confirms that he is fully acquainted with these General Terms and Conditions and that he agrees with their application. The User is obliged to enter accurate and complete personal data in the registration process and at each subsequent entry of data, and in connection with this data gives explicit consent RubiconShop to process and store them for the purposes of its obligations in relation to Products ordered through Web shop- and or its statutory obligations, collection of receivables, development of its services and prevention of potential abuses. RubiconShop will, in accordance with applicable regulations, take all available measures to protect data about the User, as well as data on the purchase. This information will be considered a business secret. User Information provided by the User to RubiconShop may be used to deliver advertising notices via email. Each such message must enable the User to easily delete his address from the mailing list.

Prices

Product prices are expressed in euros and are expressed in gross amount (including all taxes) and do not include possible delivery. Exceptionally, some products may have a prominent price without VAT in addition to this one. Product prices are subject to change until the moment of payment. Also, RubiconShop reserves the right to change prices without displaying the changes on the Web Shop, or to display them with a delay. Delivery of Products purchased through the Web shop to the User's address is made at the expense of the User, unless otherwise agreed. The delivery price is announced to the buyer after the order has been placed. The customer can pick up the purchased products himself, in the RubiconShop store.

Payment Method

Payment is made in cash, by bank transfer or via bank cards VISA, Master Card, Maestro.

Shipping

Delivery of Products ordered through the Web shop is done to the address of the User specified by the User when registering. Delivery is possible only on the territory of Montenegro. After recording the ordered Products, the data that RubiconShop deems necessary are checked, respecting the positive legal regulations, by checking through the database of authorized RubiconShop services or by calling the User, all in order to check the fulfillment of conditions for the purchase. In the event that after the verification referred to in the previous paragraph, the competent services of RubiconShop determine that the User is unable to purchase the Product, the User will be notified of the mentioned to the e-mail address specified when registering.

If for any reason the User enters incorrect information when submitting the order request, RubiconShop is not responsible for non-delivery of the Product. In case of technical reasons etc. RubiconShop is not able to deliver the purchased Products, RubiconShop will immediately notify the User of new changes and new delivery deadlines, or, in case of inability to make delivery within a reasonable time, the refund.

Reservations

The subject of purchase (Product) is reserved by the User only after the payment has been made. Upon payment, and before collection / delivery, the Product specification cannot be changed. The user cannot cancel the order after the payment has been made. After collection / delivery, it is not possible to cancel the purchase and cancel the amount charged. In the period from ordering the Product to confirmation of payment, there is a possibility that the appropriate quantities of products are no longer available, of which the User will be notified by RubiconShop

User notification

When ordering the Product through the Web shop, the User clearly and unambiguously confirms that he is familiar with the basic features of the Product that is the subject of purchase, as well as: name, headquarters, address, e-mail address and other information necessary to identify RubiconShop; selling price (including the way in which the selling price is calculated); the ability to spot and correct data entry errors before sending a purchase order; the manner of payment and delivery deadline, the manner of fulfillment of other contractual obligations, as well as the manner in which the User's complaints are handled; the support provided by RubiconShop to the User after the sale, contractual guarantees and the conditions under which the User is entitled to contractual guarantees; the obligation of the User to provide any form of security at the request of RubiconShop and the conditions under which this obligation may arise; opportunities for the User and RubiconShop to resolve their possible disputes out of court (arbitrators or mediators); the right to protection of the User in accordance with positive legal regulations

Complaints

RubiconShop will respond to all complaints of the User within the legally prescribed deadline for resolving complaints. Depending on the subject of the complaint, at the request of RubiconShop, the User is obliged to submit the warranty card and invoice that came with the Product. RubiconShop is not responsible for customer complaints made for non-delivery of the Product that is not caused by his fault. The warranty for the delivered Products is given by the authorized manufacturer, ie the authorized service and distributor. The guarantor guarantees that the delivered Products are new, unused, that the quality of components and materials used in production, as well as the quality of technical workmanship meet the highest technical standards. The guarantor is obliged to eliminate all defects on the delivered goods that are noticed within the warranty period free of charge, by repairing or replacing the new Product within the legally prescribed period for resolving complaints. RubiconShop guarantees that the delivered products are of the original brand, procured by authorized repairers and distributors, ie by an authorized manufacturer for the territory of Montenegro. The warranty period starts from the day of payment for Products purchased through the Web shop, which is entered in the warranty card and certified by the signature and seal of the authorized seller. The warranty conditions are given within the warranty card that the User receives upon delivery of the product. The user is obliged to hand over the delivered products for service in the original trade packaging, as the goods were delivered, with a warranty card. The user loses the right to warranty if he does not follow the given instructions for use in accordance with the given conditions from the warranty card, including the case of repair by unauthorized persons, change of the original condition of the device and others. When picking up / delivering the Product, it is the duty of the User to inspect the Product and to point out any mechanical damage.

Limitation of liability

RubiconShop strives to ensure that all product information is accurate. However, RubiconShop is not responsible if there is an error in the description of the Product, or the image of the Product does not match its actual appearance. RubiconShop will not be liable for any damages that may occur due to the interruption of the Internet connection when using the Web shop.

Final provisions

RubiconShop reserves the right to make changes to these General Terms and Conditions in accordance with its business policy or changes in positive legal regulations, of which it notifies Users in the usual way, as well as the right to change the offer of Products available through the Web shop. These General Terms and Conditions shall come into force on the day of their publication on the RubiconShop website
